Release and Waiver of Liability Form

This Release and Waiver of Liability (“Release”) executed on (date) ____________

by ____________________(name of contributor) (“Contributor”) releases Song Book World (songbookworld.org) (“Nonprofit”), Flying West Music, Berkshire Taconic Community Foundation, the NW Connecticut Arts Council organized and existing under the State of Connecticut and each of its Directors, Officers, Employees, and Agents from liability.  The Contributor desires to provide services for Nonprofit and engage in activities related to serving as contributor. 

Contributor understands that the scope of the Contributor’s relationship with Nonprofit is limited to a participant position, and that no compensation is expected in return for the services provided by Contributor; that Nonprofit will not provide for any wages, expenses, costs or other budgetary-matters traditionally associated with employment to Contributor in exchange for any services provided by Contributor; and that Contributor is responsible for his/her own insurance coverage in the event of any personal injury, illness, harm, or any damage or loss to personal property as a result of Contributor’s service to Nonprofit.

1. Waiver and Release: I, the Contributor, release and forever discharge and hold harmless Non-profit and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from the services I provide to Nonprofit. I understand and acknowledge that this Release discharges Nonprofit from any liability or claim that I may have against 
Nonprofit with respect to bodily injury, personal injury, illness, death, or property damage which may result from the services I provide to Nonprofit or occur while I am providing services as a Contributor. 

2. Insurance: I understand that Nonprofit does not assume any liability or responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits, life insurance or insurance of any nature in the event of my injury, illness, death or damage to my property. I expressly waive any such claim for compensation and any or all liability as to Nonprofit. Any 
exercise or offer of assistance by Nonprofit to Contributor in the event of any injury, illness, damage to personal property or death, is freely provided by Nonprofit in the event of such injury, illness or damage to personal property incurred by me, and in no way forms any contract, express or implied, nor does it create any liability or obligation for continuing to provide any such assistance or support. 

3. Medical Treatment: I hereby release and forever discharge Nonprofit from any claim whatsoever which arises or may hereafter arise due to any first-aid treatment or other medical services rendered in connection with my tenure as a contributor with Nonprofit.  

4. Assumption of Risk: I understand that the services I provide to Nonprofit may include activities potentially hazardous to me. As a contributor, I am expressly assuming all potential liability and assume all related risk of injury or harm from these activities. In assuming the risk involved, I am releasing Nonprofit from any and all liability for injury, illness, property damage or death resulting from the services I provide as a contributor or occurring while I am providing volunteer services. 

5. Photo, Video & Audio Release: I consent to convey to Nonprofit all rights, title and interest in any and all photographs, images, video or audio recordings of me or my likeness or voice made by Nonprofit in connection with my providing volunteer services to Nonprofit. 

6. Other: As a volunteer, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the State of Connecticut, and that this Release shall be governed by and interpreted in accordance with the laws of the State of Connecticut. I agree that in the event that any clause or provision of the Release is deemed invalid, the enforce-ability of the remaining provisions of this Release shall not be affected.

Authorization Release  -  Under 18 Years of Age

The undersigned, as the parent(s) having legal custody or as the legal guardian of 
_______________________________, a minor, do hereby give permission, consent and authorization for such minor to participate in Song Book World Activities. Subject to the exceptions set forth below, the Undersigned (1) assumes all risks associated with participation in our activities, (2) agree to indemnify, defend and hold harmless Song Book World, Flying West Music, Berkshire Taconic Community Foundation, the NW Connecticut Arts Council it’s agents, employees, officers, directors, successors and assigns and fully and forever release and discharge such parties from any and all claims of any nature to include but not limited to the following:, demands, actions causes of actions, suits, controversies, obligations and liabilities of any kind and nature whatsoever (collectively referred to as Claims) relating to personal injury, bodily injury and/or death or property damage sustained, incurred or caused by said minor afore described program or any other events and occurrences while said minor is engaged in the Program or any activity related thereto. The foregoing assumption of risk, aforementioned to indemnify and release shall further be inapplicable to and of no force and effect for any and all Claims asserted against any third party independent contractor performing services for compensation in connection with the Activities, except to the extent and amount that such third party independent contractor has a valid right, and claim for contribution, reimbursement or indemnity which is not covered by the above described insurance and is asserted against Song Book World, Flying West Music, Berkshire Taconic Community Foundation, the NW Connecticut Arts Council, its agents, employees, officers, directors, successors and assigns.
